Terms and Conditions of Sale

These Terms and Conditions are provided in French. In the event of any discrepancy between the French version of this document and any of its translations, the French version shall prevail.

 

ARTICLE 1 – SCOPE OF APPLICATION

These General Terms and Conditions of Sale (hereinafter referred to as “GTC”) detail the rights and obligations and apply, without restriction or reservation, to all sales made by Catherine Dix Ceramics, sole proprietor (hereinafter referred to as “the Seller”), to consumers, customers, and professionals (hereinafter referred to as “the Customer”) via the website catherinedixceramics.com, powered and hosted by Wix. In connection with the sale of the following goods: ceramics.

 

The Terms and Conditions are available at any time on the website and shall prevail over any other version or contradictory document.

The Customer declares that they have read and accepted these Terms and Conditions without reservation before confirming their order.

ARTICLE 3 – PRODUCTS

The products offered for sale on the catherinedixceramics.com website are original works of art created by hand by Catherine Dix.

The parties agree that the illustrations or photos of the products offered for sale have no contractual value. The Customer's attention is drawn to the fact that the products sold by Catherine Dix are all handcrafted and made by a single person: their dimensions, colors, and appearance may therefore differ slightly from the photographs published and vary significantly from one item to another within the same series, which the Customer acknowledges and accepts.

 

ARTICLE 4 – PRICES

Prices are quoted in euros (€), inclusive of all taxes (TTC).

The Seller reserves the right to modify its prices at any time. The product is invoiced on the basis of the price in effect at the time of order confirmation. They will be increased by the shipping costs applicable on the day of the order.

Shipping costs are indicated before final confirmation of the order.

 

ARTICLE 5 – DISCOUNT

No discount will be granted for early payment.

 

ARTICLE 6 – ORDER

The Customer places an order directly on the website catherinedixceramics.com, or directly with the Seller.

All orders imply full and complete acceptance of these GTC.

 

  • The order is considered final after:

  • confirmation of the shopping cart or quote,

  • confirmation of payment,

  • sending of an order confirmation email.

 

The Seller reserves the right to cancel or refuse any order in the event of a previous dispute with the Customer.

 

ARTICLE 7 – PAYMENT TERMS

Payment is due immediately upon ordering.

The following payment methods are accepted:

  • Credit card (via Stripe)

  • Bank transfer

Payments are secure. 

Bank details are never stored by the Seller.

 

Items ready for shipment will be sent upon receipt of payment.

For all items made to order, please allow 4 to 6 weeks for delivery. A 30% deposit is required at the time of order. The balance must be paid before the goods are shipped.

ARTICLE 8 – DELIVERY

Delivery is made:

  • either by direct delivery of the goods to the buyer;

  • or to the address indicated by the Customer when placing the order.

Delivery costs are payable by the buyer, as are any customs duties and taxes.

The delivery time indicated when the order is placed is given for information purposes only

and is not guaranteed.

The Seller cannot be held responsible for delays attributable to the carrier.

Consequently, any delay in the delivery of the products shall not entitle the buyer to:

  •  compensation for damages;

  • cancellation of the order.

In the event of missing or damaged goods during transport, the buyer must make

all necessary reservations on the order form upon receipt of the goods.

These reservations must also be confirmed in writing within five days of delivery,

by registered letter with acknowledgment of receipt.

 

ARTICLE 9 – RIGHT OF WITHDRAWAL

9.1 Principle

In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of 14 days from receipt of the product to exercise their right of withdrawal when purchasing digitally, without having to justify their reasons.

To exercise this right, the Customer must notify their decision by email to: catherinedixceramics@gmail.com.

Products must be returned:

  • in their original condition,

  • unused,

  • in their original packaging,

  • within 14 days of notification of withdrawal.

Return shipping costs are the responsibility of the Customer.

9.2 Exceptions to the right of withdrawal

In accordance with Article L221-28, 3° of the Consumer Code, the right of withdrawal does not apply to works:

  • made to the Customer's specific order,

  • personalized according to the Customer's choices (dimensions, colors, text, composition, etc.),

  • or clearly individualized at the Customer's request.

  • products which, by their nature, cannot be returned.

These works cannot be returned, exchanged, or refunded.

 

ARTICLE 10 – REFUND

In the event of a valid withdrawal, the refund will be made within 14 days of receipt of the returned work, using the same payment method used for the order.

No refunds will be made for works excluded from the right of withdrawal in accordance with Article 8.2.

 

ARTICLE 11 – LIABILITY

The Seller shall not be held liable for:

  • misuse of the product,

  • use not in accordance with the instructions,

  • indirect damage.

The Seller's liability shall in any event be limited to the amount of the order.

 

ARTICLE 12 – LEGAL WARRANTIES

The products are covered by:

  • the legal warranty of conformity (Articles L217-3 to L217-20 of the Consumer Code),

  • the warranty against hidden defects (Articles 1641 to 1649 of the Civil Code).

The Customer has a period of 2 years from the delivery of the product to take action.

 

ARTICLE 13 – PERSONAL DATA

Personal data collected is processed in accordance with the GDPR.

The methods of collection and processing, and the Customer's rights, are detailed in the Privacy Policy available on the website.

 

ARTICLE 14 – TITLE RETENTION CLAUSE

The Seller retains ownership of the goods sold until full payment of the price, including principal and incidental costs. As such, if the buyer is subject to receivership or judicial liquidation, the Seller reserves the right to claim, within the framework of the collective proceedings, the goods sold and remaining unpaid.

ARTICLE 15 – INTELLECTUAL PROPERTY

All elements appearing on the catherinedixceramics.com website and, more generally, the entire artistic universe of Catherine Dix Ceramics, are protected by the provisions of the Intellectual Property Code and applicable international conventions.

This includes, but is not limited to:

  • works, creations, ceramic pieces,

  • photographs, images, videos,

  • texts, descriptions, logos,

  • the name “Catherine Dix Ceramics,”

  • as well as any associated visual or artistic variations.

This protection extends to all media, whether:

  • published on the website,

  • disseminated on social networks,

  • published in the press or in any other media,

  • communicated for promotional, editorial, or institutional purposes.

 

Any reproduction, representation, modification, adaptation, distribution, or exploitation, in whole or in part, of these elements without the prior written permission of Catherine Dix Ceramics is strictly prohibited and constitutes an infringement under Articles L.335-2 et seq. of the Intellectual Property Code.

Use of images

The use of images of Catherine Dix Ceramics' works may be authorized solely for non-commercial purposes, provided that the following reference is systematically and clearly mentioned: 

“Courtesy Catherine Dix Ceramics.”

 

Any other mention, removal of credit, modification of the image, or use outside the authorized scope is prohibited.

Prohibition of commercial use

It is strictly prohibited to:

  • sell, resell, rent, or commercially exploit,

  • monetize, directly or indirectly,

  • use for advertising or commercial purposes,

 

Images of Catherine Dix Ceramics' works, including in the form of reproductions, prints, derivative products, NFTs, digital or physical media, even when the images are freely accessible online.

 

Reservation of rights

Catherine Dix Ceramics reserves the right to take any legal action necessary to enforce its intellectual property rights and obtain compensation for any damage suffered.

 

ARTICLE 16 – FORCE MAJEURE

The seller shall not be held liable if the

non-performance or delay in the performance of any of its obligations described in these

general terms and conditions of sale results from a case of force majeure. In this respect, force

majeure refers to any external, unforeseeable, and unavoidable event within the meaning of Article

1148 of the Civil Code.

 

 

ARTICLE 17 – CONSUMER MEDIATION

In accordance with Articles L612-1 et seq. of the French Consumer Code, the Customer may seek the assistance of a consumer mediator free of charge with a view to reaching an amicable resolution to a dispute.

ARTICLE 18 – APPLICABLE LAW AND DISPUTES

These Terms and Conditions are governed by French law.

 

In the event of a dispute relating to the interpretation and execution of these GTC, an amicable solution will be sought before any legal action is taken. Failing this, the Commercial Court of Périgueux (3 Pl. Yves Guena, 24000 Périgueux - France) shall have jurisdiction.
