General Terms and Conditions of Sale

These Conditions are provided in the French language. In the event of any discrepancy between the

French version of this document and any translation thereof, the French version shall prevail.

Clause 1: Purpose

The general terms and conditions of sale described below detail the rights and obligations of the

companyCATHERINE DIX CERAMICS and its customer in connection with the sale of the following goods:

Clause 2: Products

The parties agree that the illustrations or photos of the products offered for sale have no contractual

value. The Customer's attention is drawn to the fact that the products sold by CATHERINE DIX

CERAMICS are all handmade by a single person: their dimensions, colours and appearance may

therefore differ slightly from those shown in the published photographs and may vary significantly

from one item to another within the same series.

Clause no. 3: Prices

The prices of the goods sold are those in force on the day the order is placed. They

are denominated in euros and calculated exclusive of tax. Consequently, they will be increased by

the transport costs applicable on the day the order is placed.

CATHERINE DIX CERAMICS reserves the right to modify its prices at any time.

However, it undertakes to invoice the goods ordered at the prices indicated at the time of

the order is registered.

Clause 4: Discounts and rebates

The prices quoted include any discounts and rebates that CATHERINE DIX CERAMICS may grant on

the basis of its results or the assumption of responsibility by the purchaser for certain services.

No discount will be granted for early payment.

Clause 6: Terms of payment

Orders must be paid for :

- by bank transfer ;

if applicable, indicate the other means of payment accepted.

Items ready for dispatch will be sent on receipt of payment.

For all items made to order, please allow 4 to 6 weeks for delivery. A 30% deposit is required at the

Clause 7: Late payment

In the event of total or partial non-payment of the goods delivered on the date of receipt,

Clause 8: Resolutory clause

Clause No. 9: Retention of title clause

Delivery costs are the responsibility of the buyer, as are any customs fees and taxes.

The delivery time indicated when the order is placed is provided for informational purposes only and

is not guaranteed in any way.

Consequently, any reasonable delay in the delivery of the products may not give rise to the buyer's:

• the award of damages;

• cancellation of the order.

The risk of transport is borne entirely by the buyer.

In the event of missing or damaged goods during transport, the buyer must state all necessary

reservations on the order form upon receipt of said goods.

These reservations must also be confirmed in writing within five days of delivery,

by registered letter with acknowledgement of receipt.

Clause No. 11: Force Majeure

CATHERINE DIX CERAMICS shall not be held liable if the non-performance or delay in the

performance of any of its obligations described in these general terms and conditions of sale results

from a case of force majeure. In this regard, force majeure means any external, unforeseeable, and

irresistible event within the meaning of Article 1148 of the Civil Code.

Clause No. 12: Competent CourtAny dispute relating to the interpretation and execution of these general terms and conditions of

sale is subject to French law.

Failing an amicable resolution, the dispute will be brought before the Périgueux Commercial Court

(3 Pl. Yves Guena, 24000 Périgueux).
